These questions often arise and an answer, although "simple" from a technical point of view, takes on wrinkles within which major complications can hide.
An interesting and well-researched article by Tiziano Menduto on puntosicuro, the link of which we attach, concludes as follows:
“Let us remember, first of all, if in the Resolution of the Council of Ministers of 07 October 2020 the state of emergency was extended until 31 January 2021, the Council of Ministers, meeting on 13 January, has now resolved on the new extension of the state of emergency until to the 30 April 2021.
In relation to what is indicated by the coordinated reading of Legislative Decree 125/2020, of Conversion Law 159/2020 and of Legislative Decree 18/2020, all certificates relating to training courses expiring during the emergency period they remain valid until ninety days following the declaration of the end of the state of emergency epidemiological from COVID-19.
And therefore, with the new extension of the state of emergency, they retain their validity until July 29 2021.
We also point out that the law converting the decree-law of 7 October 2020, n. 125 has been in force since 4 December 2020, the day following publication in the Official Journal."
Although technically correct, the invitation to reflect is appropriate since if the above is potentially correct in the case of supervisory activities by the competent bodies, there could be significant pitfalls in the event of an accident.
We remind you that, when faced with checks, the three pieces of evidence required for the defense are:
- Supervision
- training
- risk assessment and specific work procedures/instructions.
In this case, if the certificate has expired, are the established and binding criteria respected?
As usual, things must be analyzed on a case-by-case basis and addressed accordingly.
We remind you that the technical tools to carry out training activities exist today, except in particular cases which, in fact, must be evaluated on a case-by-case basis.
